This year…

The Voice of the Profession

R3 has been at the heart of the biggest issues affecting our profession in 2018. We’ve published influential reports on CVAs and IVAs, made sure Government policy reflects the profession’s views on a post-Brexit framework for cross-border insolvency work, persuaded the Government to make significant changes to sweeping corporate insolvency reforms, and fed members’ views into government reviews of ‘phoenix’ companies, pre-packs, pensions, economic crime, insolvency litigation funding, airline insolvencies, and more.

To get the profession’s voice heard, we’ve put members in the room with the UK insolvency minister, the Scottish insolvency minister, influential parliamentary select committee chairs, dozens of MPs and journalists, as well as senior policymakers at the Treasury, Insolvency Service, and Ministry of Justice. R3 and our members have appeared across the BBC, ITV, and the national and local press to explain and promote the profession’s work.

Technical Support

R3 has been tackling our members’ day-to-day frustrations, too. We’ve established a taskforce to address members’ concerns with the Official Receiver, worked with HMRC to ensure members’ feedback is listened to, and worked with the Insolvency Service and the RPBs to resolve members’ technical and regulatory queries.

R3 Events

R3’s events team has put on over 150 events and courses, including local technical briefings, networking events, and national conferences, catering for members’ needs regardless of their experience, firm size, or speciality. Our policy and technical teams have also put on a series of member forums to allow members to have their say on government insolvency reform.

The high street and corporate insolvency reform

Whether it’s speaking with journalists to help them understand the UK’s insolvency and restructuring framework, ‘myth busting’ the work that our members do when working on retail insolvencies, or briefing the chairs of parliamentary select committees on Company Voluntary Arrangements (R3 published a report on CVAs earlier this year), R3 has been making sure that the work its members do is clearly understood by those who shape the public debate, and ultimately the framework that members work within.

Corporate insolvency has captured much of the imagination in 2018. Whilst the high street has dominated the headlines, it was the government’s announcement in August that it would press ahead with its 2016 corporate insolvency reforms after significant campaigning from R3 that was the big R3 achievement for 2018. The reforms (read more here) are vital if the UK is to maintain its internationally renowned insolvency and restructuring framework once we’ve left the EU.

Brexit

On Brexit, R3 has been working with the government, and the Opposition, to make sure that the profession’s voice is loud and clear in the government’s negotiations. R3 worked with the Opposition during the European Withdrawal Bill in spring this year to put pressure on the government (who had already adopted R3’s position to preserve the benefits of the Insolvency and Judgments regulation) to explain how it is seeking existing insolvency and restructuring benefits of EU membership. As part of its Brexit work, R3 also met with the insolvency minister to discuss the government’s approach to insolvency.

In 2018 R3 also:

  • Established a taskforce to review the work between insolvency practitioners and the Official Receiver.
  • Published a well received report on strengthening the regulatory framework for the volume IVA provider market.
  • Met with government officials, parliamentarians and the business community to discuss R3’s views and recommendations on; the impact of the 2015 pre-pack reforms (ahead of the government’s review on whether it will ban or regulate connected party sales); the powers of The Pensions Regulator; the impact of the 2012 Legal Aid, Sentencing and Punishment of Offenders Act on insolvency litigation funding; the government’s proposed changes to the airline insolvency framework
  • Met with the Scottish insolvency minister (twice) and cross party MSPs to brief them on the work and value of the profession, discuss future reform of the personal insolvency framework, and government initiatives R3’s Scottish members can get involved with.

Strategic Review

 R3 is always thinking about how best we can serve our members’ needs. This year, to make sure we continue to deliver real and tangible value for our members, we’ve been undertaking a root and branch review of our strategy, operations and priorities. We’ve put everything under the microscope to make sure we’re fit for the future.

We’re using this review to…

  • Maintain our position as the leading association for professionals advising businesses and individuals in financial distress;
  • Make sure R3 remains relevant to all members, wherever you work in the profession, and at whatever stage of your careers you have reached;
  • Ensure R3 represents the insolvency, restructuring, and related professions now and in the future;
  • Align R3 with the direction of travel of member firms and the market.

R3 members have been at the heart of this review. We’ve been speaking and listening to hundreds of members up and down the country about how they use R3 and what they want from their membership association. Important member-led taskforces are now looking at:

  • R3’s member services and member value;
  • R3’s events and membership structure;
  • How R3 represents the whole profession;
  • R3’s member communications and corporate governance.

Hopefully you have noticed a change in R3 over the course of 2018 – there are lots more positive changes to come during 2019 and beyond.
